Prop 64 Passes in California, 2016​

Californian voters gave the green light on recreational marijuana Tuesday, approving Proposition 64, officially making the state the most densely populated to do so.

Many cannabis proponents believe that clearing a hurdle of this magnitude could be the progress needed to push federal legislators to unschedule marijuana from its current classification under the Controlled Substance Act.

While law enforcement officials express discontent with the voter outcome, Nate Bradley, executive director of the California Cannabis Industry Association, had this to say. “We are very excited that citizens of California voted to end the failed policy of marijuana prohibition. Proposition 64 will allow California to take its rightful place as the center of cannabis innovation, research and development.”

California Legalized Marijuana First

In 1996 California was the first state to legalize medical marijuana. Just 6 years ago California voters denied the passage of a comparable initiative.

Residents of California have had a long and laborious fight, but financial support and backing has bloated over the 20 year span and finally secured a victory for cannabis advocates.

Law enforcement officials have scrutinized the ballot measure, and say they will tightly supervise the application of the new laws.

“We will take a thorough look at the flaws in Proposition 64 that will negatively impact public health and safety, such as the initiative’s substandard advertising restrictions and lack of prosecutorial tools for driving under the influence of marijuana, and begin to develop legislative solutions,” Chief Ken Corney said.

The president of the California Police Chiefs Association, Ken Corney also stated,

“We are, of course, disappointed that the self-serving moneyed interests behind this marijuana business plan prevailed at the cost of public health, safety, and the wellbeing of our communities.”

Who Influenced This Drug Policy Reform

There is no doubt that billionaire and patron of drug policy reform, George Soros, has had quite the influence on overturning prohibition in California. He endorsed the states which rejected Proposition 19, back in 2010 for around $1 million dollars.

This year Soros, along with former Facebook President and entrepreneur Sean Parker, managed to help raise roughly $16 million for the campaign. A reported sum of $23 million was brought in from various state committees, although, Parker is said to be the major financier for this particular measure.

Under Proposition 64 Californians of, and over the age of 21, would be allowed to use, possess, buy and transport up to 28 grams ( 1 ounce) of marijuana, recreationally. Individuals could be approved to grow up to 6 plants at home, for personal use.

Retail sales of cannabis would come with a mandated tax of 15%. While the law will be directly implemented, like every other state that has passed pro cannabis legislation, there will be a delay in availability and regulatory developments.

Only California licensed businesses will be permitted to sell recreational marijuana. This means that regulations will have to be cemented before any license can be issued. The state has until January 1st, 2018, to get the proceedings in motion.

Analysts have projections that show likely increases in tax revenue upwards of a billion dollars annually. The passage of the bill will also provide a large assortment of new employment opportunities within local communities. With the soil quality and preferable climate, California is now positioned to move to the forefront of the cannabis industry.

Still, we are hearing from many disputants that feel the passage could cause more harm than good.

“It’s disappointing that big marijuana and their millions of out-of-state dollars were able to influence the outcome of these elections,” said former Rep. Patrick Kennedy, an advisor from SAM Action. “We will continue to hold this industry accountable, and raise the serious public health and safety issues that will certainly come in the wake of legalization.”

Marijuana Law Enforcement Opposition

The majority of law enforcement groups firmly opposed the ballot measure and illustrated concern over the increase in issues in other recently legalized states, including impaired driving and drug abuse in teens.

Lynne Lyman, of the Drug Policy Alliance, said, “The new law focuses on undoing the most egregious harms of marijuana prohibition, which have disproportionately impacted communities of color,” she says, adding it will be “protecting youth by preventing access to marijuana.”

Lt. Governor Gavin Newsom professed that the "war on drugs" has failed and wasted law enforcement efforts and resources.Newsom has said, “I think it’s the beginning of the end of the war on marijuana in the United States. I think it will have repercussions internationally, particularly in Mexico and Latin America. And there are a million people who tomorrow can begin the process of clearing their records.”
